By accessing, purchasing, or using any service offered by Apex Viral AI ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be fully bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you should not proceed with a retainer agreement.
These Terms apply to all clients, visitors, and others who access or use our services, including but not limited to short-form content production, AI-powered visual generation, and content distribution strategy.
Apex Viral AI is a premium short-form content production company that specialises in transforming long-form media - including podcast recordings, webinars, keynote speeches, and YouTube videos - into high-retention, algorithm-optimised short-form assets designed to grow your audience and drive measurable business results.

We offer three service plans: one introductory one-time pilot and two ongoing retainer plans. Retainer plans are available on a bi-weekly or annual billing cycle. All plans include dedicated human editors working alongside AI tools to deliver production quality that purely automated tools cannot replicate.

An introductory one-time plan designed for creators and businesses evaluating our system before committing to an ongoing retainer. The $400 pilot fee is credited in full toward your first retainer billing period - whether you choose The Accelerator or The Omnipresence, if you choose to continue. Includes:

By securing a retainer, you acknowledge that Apex Viral AI immediately allocates dedicated production resources - including editorial time, AI compute, and a private communications channel - to your account. All prices are listed in USD. We reserve the right to update pricing with reasonable advance notice, and existing retainers will be honoured at the agreed rate for the current billing period.
To ensure timely and high-quality delivery of your assets, you agree to:
Delays caused by the client in providing necessary access or materials do not extend or pause the active billing cycle. Apex Viral AI is not liable for production delays that are a direct result of late, incomplete, or inaccessible material submissions.
The Ignition: Delivery of all 7 short-form assets is completed within 7 calendar days of material access being granted. Assets are delivered digitally via cloud storage link (e.g., Google Drive) with one included revision round before final sign-off.
Retainer Plans: Onboarding is completed within 24 hours of retainer confirmation. Your dedicated communication channel is established and production begins immediately upon material access being granted. Deliverables are provided digitally via cloud storage links (e.g., Google Drive) and distributed throughout the billing period for consistent posting cadence - not delivered in a single batch at the end.
The Ignition pilot includes one full revision round before final delivery, which must be requested within 7 days of the final asset delivery. Accelerator and Omnipresence retainer clients receive multiple revision rounds per production batch at no additional cost. All revision requests must be submitted through your dedicated communication channel within 5 business days of delivery. Requests submitted after this window may be accommodated at the team's discretion depending on production scheduling.
Revisions cover pacing adjustments, caption and text corrections, minor visual changes, and VFX tweaks. Requests that constitute a complete creative re-direction or fundamental restructuring of an approved asset may be treated as new production work.
All client communication is managed through a dedicated private Slack or Discord channel established during onboarding. This gives you direct access to your content partner for rapid feedback, file sharing, and status updates without the friction of email threads. Formal notices - including billing communications and legal matters - will be delivered via email.
The Ignition is a one-time purchase and does not involve a recurring retainer. There is no cancellation process applicable - no future charges will be made beyond the initial $400 payment. The pilot fee is non-refundable once production has commenced.
For ongoing retainer plans, you may cancel at any time through the secure Whop Client Portal. Cancellations take effect at the end of the current active billing period, with no further charges made thereafter. We operate on a fully flexible, commitment-free model - there are no long-term lock-ins, exit penalties, or cancellation fees.
All payments made to Apex Viral AI are non-refundable. No partial refunds or credits will be issued for any unused portion of an active billing period. This applies to both bi-weekly and annual plans. Upon payment, production capacity - including editorial time, AI compute, and a dedicated communications channel - is allocated to your account immediately and cannot be recovered.
Annual retainers are non-refundable once the billing cycle has commenced, as full annual production capacity is reserved exclusively for your account across all 26 bi-weekly periods. If you have concerns about committing to an annual plan, we recommend starting bi-weekly and switching at renewal.

Apex Viral AI is built on a genuine commitment to producing the highest-quality short-form content achievable. Our systems, creative processes, and editorial workflows are engineered with growth in mind - and our client outcomes reflect that commitment.
That said, content performance is shaped by a wide range of factors that fall outside the scope of production quality alone. These include your industry vertical, audience demographics, platform algorithm changes, posting frequency, the competitive landscape in your niche, and the nature of your underlying long-form source material. A business in a high-CPM, engaged niche will naturally experience different results than one operating in a crowded or low-engagement category - and that is simply the reality of the attention economy.
Apex Viral AI does not guarantee specific metrics, including but not limited to views, follower growth, leads generated, or revenue attributed to content produced under this agreement. Our responsibility is to deliver professionally produced, algorithmically-informed assets that give your content the strongest possible foundation for performance. What those assets achieve in-market is influenced by factors unique to your business, audience, and platform presence.
Upon full payment for each billing period, you retain full ownership of all final delivered video assets. Apex Viral AI retains the right to reference, display, or showcase anonymised or client-approved examples of the work in our portfolio, case studies, and marketing materials, unless you explicitly request otherwise in writing prior to production commencing.
You represent and warrant that all source materials submitted to Apex Viral AI are either owned by you or that you hold the appropriate rights and licences to use them for the purposes described in these Terms.
Both parties agree to keep confidential any proprietary business information, brand strategies, unreleased content, or sensitive materials shared during the course of the retainer. Apex Viral AI will not share, sell, or disclose your personal data, content, or business information to any third party without your explicit consent, except where required by applicable law.
To the maximum extent permitted by applicable law, Apex Viral AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our services. Our total liability under any claim arising from these Terms shall not exceed the total fees paid by you in the most recent billing period.
We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or through your dedicated communication channel with reasonable advance notice. Continued use of our services following notification of such changes constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms or the services provided shall first be attempted to be resolved through good-faith negotiation between both parties before any formal proceedings are initiated.
